Welcome to Real Assist. These Terms of Service ("Terms") govern your use of our services and establish the terms of our relationship. By engaging Real Assist, you agree to these Terms, which work in conjunction with the Exclusive Real Estate Agent Contract signed between Real Assist, LLC ("we," "our," "Real Assist") and you, the client ("you," "your," "Client").
Real Assist provides real estate assistance and lead generation services through our comprehensive package. These include:
12–16 qualified leads per month
Targeted ad campaigns (includes $750/month ad spend)
Custom content creation and SEO blog posts
Premium website design (one-time fee applies)
Hosting and ongoing website maintenance
Personalized education and sales training access
A dedicated Personal Assistant providing administrative and marketing support
Full service details are outlined in your signed Exclusive Real Estate Agent Contract.
By signing up for our services, you affirm that:
You are a licensed real estate agent in the United States
You have the authority to enter into this agreement
You will provide accurate, up-to-date information
You will actively communicate and collaborate with your assigned Personal Assistant and our team to ensure campaign effectiveness
Service fees range from: $1739 to 4,500 per month, due on the 1st of each month
One-time $3,000 website design fee, due at signup (non-refundable)
Late payments are subject to a 5% late fee if not received within 7 days of the due date
We reserve the right to pause or terminate service if payment is not received on time
We may modify our fees with 30 days’ notice. Continued use of the service after the notice period constitutes acceptance of the new pricing.
A 90-day minimum commitment is required before cancellation can be requested.
After the initial period, you may cancel at any time with 30 days’ written notice sent to property.real.assist@gmail.com.
Real Assist may cancel the agreement immediately in case of:
Non-payment
Breach of contract
Upon termination, any outstanding balances must be paid within 15 days.
Clients who prepaid will receive a prorated refund for unused time excluding:
Setup fees
Website fees
Advertising spend (non-refundable)
Ad spend is non-refundable under any circumstance, as funds are allocated to third-party platforms immediately upon campaign scheduling.
Real Assist agrees to exclusive territory rights for each Client. We will not provide competing lead generation services in your defined market area during the active term of your contract.
The Client agrees not to engage with competing lead generation or marketing services that offer overlapping capabilities within the designated territory.
After full payment of the $3,000 website design fee, you retain full ownership of your website. Real Assist reserves the right to showcase the website in its portfolio unless otherwise agreed in writing.
We guarantee a minimum delivery of 10 qualified leads per month. If we do not meet this threshold, you will receive a $250 credit per missed lead, up to a maximum of $750 per month.
To the maximum extent permitted by law:
Real Assist is not liable for any indirect, incidental, special, or consequential damages (including lost profits or data).
Our total liability is limited to the amount you paid in the 30 days prior to any claim.
We take data privacy seriously. Both parties agree to:
Maintain confidentiality of shared information during and up to 2 years after the agreement ends
Follow applicable data laws (GDPR, CCPA)
Store client data using encrypted technologies
Never share your data without written consent
Please refer to Section 4 above for our full cancellation policy.
Any dispute will first be attempted to be resolved via mediation in your state of residence. If unresolved, disputes will be submitted to binding arbitration under the American Arbitration Association, held in a jurisdiction selected by Real Assist.
This agreement will be governed by the laws of the state in which you reside, unless otherwise stated in your service contract.
We may update these Terms from time to time. All changes will be effective upon posting. Your continued use of Real Assist’s services after any such updates constitutes acceptance of the revised Terms.
Real Assist Refund Policy
Real Assist is committed to delivering high-quality services that help real estate professionals grow their business efficiently. Our refund policy is designed to be fair, transparent, and aligned with the terms of your service agreement.
Prepaid Services & Prorated Refunds
If services are terminated by either party, clients who have prepaid for future months will receive a prorated refund for unused services.
Setup, onboarding, and website design fees are non-refundable, as these involve one-time, upfront work that cannot be recovered.
Ad Spend is Non-Refundable
Any funds allocated toward advertising spend (e.g., Facebook Ads, Google Ads, Instagram, etc.) are non-refundable, regardless of performance or early termination. These amounts are paid directly to third-party platforms and cannot be reclaimed once spent or scheduled.
No Refunds on Used Services
Refunds are not issued for services already rendered, including:
Leads delivered
Ads run or scheduled
Time invested by Personal Assistants
Completed training or consulting sessions
Limitations on Refund Eligibility
Refunds may only be issued if cancellation notice is provided in accordance with the 30-day requirement, after completing the initial 90-day commitment.
Clients who fail to make payments or breach the agreement may forfeit eligibility for any refund.
Liability Cap
Real Assist’s total liability in any claim or dispute is limited to the amount paid by the client in the one (1) month preceding the claim.
Real Assist is not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, missed deals, or business interruption.
Dispute Resolution
If you believe a refund is warranted or have concerns regarding charges, please contact our support team within 15 days of service termination. We aim to resolve issues promptly and fairly.
At Real Assist, we believe in transparency and fairness. Please review our cancellation policy below, which outlines the terms for terminating services.
Initial Commitment Period
All new clients agree to a 90-day initial commitment, starting from the date of the first payment. This trial period ensures sufficient time to evaluate the full value of our services before considering cancellation.
Termination by Either Party
After the 90-day initial term, either party may terminate the agreement with a minimum of 30 days’ written notice. Notice must be submitted in writing via email or another agreed-upon communication method.
Termination by Real Assist
Real Assist reserves the right to terminate the agreement immediately in the event of:
Non-payment or failed billing
Breach of the terms outlined in the service agreement
Outstanding Balances
Upon termination, the client must settle any outstanding payments within 15 days. Unpaid balances may result in collections procedures or legal action.
Refunds and Prorated Credits
If the client has prepaid for services beyond the termination date:
A prorated refund will be issued for unused services.
Setup fees, onboarding fees, and website design fees are non-refundable.
